We advised Saint Gobain, a multinational company specialized in designing, manufacturing and distributing construction products, in the negotiation for the termination of the lease for its offices. The term agreed for the lease was mandatory, hence in the event of early termination our client would be subject to the payment of a penalty as of US$720,000.00.
The main objective of our services was to negotiate with the landlord the reduction and/or elimination of this penalty, which was complex, due to the landlord had granted this lease executed with Saint Gobain as a guarantee before the Bank to secure other obligations.
After a long negotiation, it was possible to obtain a conciliatory proposal that was beneficial for both the owner and our client. The proposal resulted in renting another office with less footage and better distribution that was more economical for our client. With this proposal, the early termination of the original contract proceeded without payment of the penalty but with the commitment to relocate the space and sign a new lease for an office that was more in line with the current interests of our client.
