We advise our client, a leading company in the commercialization and generation of associated electrical energy, in the elaboration of a protocol for the constitution of guarantees on real estate and movable property, as well as in the elaboration of the contract models corresponding to said guarantees, necessary to extend and diversify its business operations to include financing operations.
The creation of this protocol considered all the contractual, legal and commercial aspects that must be considered when constituting guarantees, taking into account the diversity of types of guarantees on personal property that may exist given the type, registration in the registry, among others. This protocol included all the necessary clauses that should be included in the guarantees, both for registrable and non-registrable assets, in order to protect ATRIA’s position as a lender.
Likewise, we take care of implementing the protocol, constituting guarantees to support loans granted by our client. Our review included the study of the titles of the properties on which the mortgage guarantees would be constituted, as well as all the aspects related to the formalization of said contracts.
