Our client —one of the most important companies in the agricultural sector in the country— requested us to carry out a technical legal study of a property that they have owned for more than twenty years to determine the best strategy to obtain the title of this property. As a background of this assignment, the company that has future expansion projects on this property, requested the analysis by different legal suppliers to determine the feasibility for obtaining the formalization of its ownership, without success. In our technical legal analysis, we were able to determine that, although this property was located in an uncultivated area and very close to the Colán Peasant Community, it was not within the boundaries of the communal land and, therefore, it was possible to initiate the land recuperation actions to acquire ownership of it before the respective state entities. Our analysis has allowed our client to know with certainty the technical legal situation of its land and has included the corresponding legal strategy to achieve the acquisition of the property and/or of some right that allows the use and exploitation of the land in favour of the company.
