The client requested us to establish and execute the best contractual framework that could be established so that they could hand over part of their land for the use of five community members of nearby rural communities and, in turn, they could carry out various activities for the benefit of both parties.
In response to this request, the case was studied, and it was determined that the best way was to establish a framework agreement between both parties, containing the obligations and rights, as well as the responsibilities in case of any inconvenience.
The particularity of this case is that the land to be transferred had parts declared as archaeological zones, which are under the custody of the client, so the regulatory framework to be established had to be very precise and detailed to avoid possible damages to these areas and, if necessary, to establish the responsibilities of each party in these events.
Our advice and drafting of the framework agreement has allowed our client to have a support to dispose and optimize their land with the due responsibility required in this type of cases, especially for the archaeological areas that exist in the place.
