The client is one of the main supermarkets in the country, having stores nationwide, so we were asked to conduct a legal study regarding the need/obligation to implement measures to prevent their air conditioning equipment and refrigerators generate noise that can cause discomfort in the neighbours of the premises.
Thus, we proceeded to conduct a legal study on the legal technical regulation of noise emitted by commercial activities, which is quite generic and is not updated to the different assumptions that are being presented in reality, which generated that we have to make a systematic interpretation and in accordance with the rights of the company and the neighbours, allowing us to find a middle ground and solution to the noise nuisance that could be causing the neighbours.
Our legal report has allowed the client to know exactly the regulations governing this issue and the implications of their actions for the neighbours of their various premises that they have nationwide. Likewise, it allows them to optimize their premises since by knowing the measures established by the municipal and national authorities, they can comply with them and avoid pecuniary sanctions and/or closure of premises.
