Jose Antonio Olaechea/Estudio Olaechea filed an opposition to the registration of the CANDELA JARA trademark and characteristic logo, in class 45.
The Trademark Office declared the opposition founded in the first instance; however, it was denied in the second instance. Bearing in mind that the logo requested by CANDELA JARA is almost identical to that of Estudio Olaechea and that it is vitally important to protect its brand against third parties, we initiated a legal proceeding to challenge the administrative decision.
The Contentious-Administrative Court declared the claim founded. Candela Jara appealed, and the procedure is pending resolution by the Superior Court, in the second instance.
