Infor (BARNEVELD) B.V. initiated an infringement action for indue use of copyright (source code) against Corporacion Grafica Navarrete S.A., the Peruvian Copyright Office declared the unfounded the action. Infor (BARNEVELD) B.V. appealed and the INDECOPI Administrative Court declared the founded the infringement action but did not recognize the payment accrued for improper use of the source code.
Infor (BARNEVELD) B.V. initiated a legal action to challenge the administrative decision, the Court of First Instance declared the claim unfounded. Infor (BARNEVELD) B.V. appealed of the Resolution and the Supreme Court declared the claim founded, granting recognition of the accrued payment, for which the INDECOPI Administrative Court has issued a new resolution acknowledging the accrued payment, requesting that we present the liquidation and support for the cost of the code font.
This process has been vital and important for the client, since the acknowledgment of the infringement action is not enough if it is not established for the accrued payment, which to date is more than half a million dollars owed.
