Desarrollos Terrestres S.A is part of Terra Towers, a group dedicated for more than 26 years to the installation of security and telecommunications infrastructure.
We acted as legal advisors of the client in a complaint filed by one of its suppliers for the alleged commission of fraud, illicit appropriation, and labor offences. This complaint was directed against the General Manager and two of his attorneys-in-fact, one of whom was a lawyer of the firm.
This complaint was based on the fact that the client had been late in making payments and the supplier considered that this would imply the commission of an offence.
We participated in the scheduled proceedings and prepared a defense brief. At the same time, the client reached an agreement with the supplier for the payment of the debt, and an out-of-court settlement was concluded.
This agreement was submitted to the Public Prosecutor’s Office for consideration when making a decision.
Based on our arguments and the settlement, the Public Prosecutor’s Office ordered the case to be closed, considering that the alleged facts were not of a criminal nature and should be dealt with in another way. The decision to close the case was declared consented and the case was definitively closed.
This result is important in that not only an attorney-in-fact, but also the General Manager and a lawyer of the firm who had certain powers of representation and who had not participated in the facts had been denounced; it was necessary to remove these persons from the investigation and prevent them from testifying, which was successfully achieved.
