We advised Telecom Business Solution a telecommunication service provider regarding the actions against the municipalities that illegally revoked the licenses for the installation of telecommunications infrastructures. In this sense, we carried out the administrative proceedings before the municipalities as well as the administrative proceedings for the elimination of bureaucratic barriers.
Importance: The lack of motivation and evidence of the allegations to revoke the licenses are proof of the arbitrariness of the municipalities. Moreover, the licenses were legally granted in compliance with the telecommunications law that establishes an administrative proceeding of automatic approval. These arbitrary actions taken by the municipalities are of great concern, particularly taking into consideration that the deployment of telecommunications infrastructure was declared a matter of national interest, and the connectivity divide. Moreover, digital transformation has been promoted as one of the main priorities for national agenda; therefore, the deployment of telecom infrastructure is crucial to achieve such objectives.
Currently, we have achieved the suspension of the illegal and arbitrary enforcement proceedings initiated by the municipalities in almost all cases. We have also advised the client on the analysis and interpretation of telecom rules, especially with respect to regulations applicable to telecom passive infrastructure providers, infrastructure installation specifications, and infrastructure sharing for the provision of telecommunications services. Moreover, we have recently provided advice regarding the adequacy figure of licenses for telecom infrastructures.
