We are acting as legal counsels of Viettel Perú S.A.C. (Bitel) in a major contentious-administrative process against OSIPTEL (Supervisory Board for Private Investment in Telecommunications). In this case, Bitel claims the invalid application of fines, for over US$ 1 million (in sum), related to the updated coverage service information filed in the year 2017. OSIPTEL has applied the sanctions alleging that the updated reports filed by Bitel were inaccurate and extemporary. However, the position of Bitel is that the information was duly rectified, and, in any case, there were enough merits that legally justified the reduction of the sanction.
The amount of the sanctions applied in this case, is one of the highest that has been applied in the telecommunications sector, regarding coverage service information.
Viettel is one of the biggest Asian telecommunications companies with participation in that market since 1989. In Peru, it is the 4th most important telecommunications company, and it represents more than 15% of the Peruvian Telecommunications market having national coverage.
