Client Requirement: In Peru, the use and rights over water resources is quite regulated by the Government. The governmental agency in charge to surveillance these regulations is The Water National Authority (ANA by its acronyms in Spanish). Since the aquaculture activity of our Client is developed within a lake in the mountains of Peru, there are frequent governmental administrative relationships with ANA. Unfortunately, this year our Client has faced some administrative process derived either from the lack of understanding of the aquaculture business by ANA or because the overlapping of functions of ANA with another governmental agency in charge of the surveillance on environmental obligations called OEFA. Our Client requested us to assist it to educate ANA about the aquaculture business and to clear up the overlapping functions between ANA and OEFA.
Our participation: ANA for sure has a great and sophisticated knowledge on water regulations but that knowledge should be wisely combined with each of the economic activities that are impacted. Few years ago, the aquaculture activity in lakes was only developed with artisanal methods. It is with our Client investment that the lake aquaculture in Peru has evolved into an industrial level and therefore the governmental officers are not necessarily aware of the industrial aquaculture business. This lack of knowledge could derive on unfair decisions, and we are involved in a constant education process. Additionally, we had the need to intermediate between two governmental agencies looking for a clean-up of their scopes overlapping.
Client benefit: Educating governmental officers or mediate within two governmental agencies are not regular legal work and our client has trusted in our experience and capacity to perform these tasks. We are in the process of completion and we expect successful results.
