Client Requirement: The Client´s business is the production and export of tangerine. For this purpose, it has entered into collaboration agreements with its related company Fundo Don Manuel. Also, the Client has entered into usufruct agreements with a bunch of landowners in connection with critical lands for the development of its business. We have advised Agricola LFC to successfully reach all these deals. In addition, this year a water resource matter was also a key factor for the business. Our Client requested our advise to properly manage such an essential resource to the business.
Our participation: The water resource rights were organized in order to benefit the lands allocated to the production of tangerine, without matter if they belong to Agricola LFC, to its related company Fundo Don Manuel or to the ones held under a usufruct agreement. This task was not easy to achieve because the Water Authority regularly forbids trespassing of water rights from owner to owner or from land to land. Rationality and efficiency principles served as legal grounds to our petition.
Client benefit: Client is now able to efficiently profit its water rights within the lands that are organized as a business unit disregarding the artificial separation among legal vehicles and usufruct agreements.
