Client Requirement: Duran Osorio is a reputed Law Firm in Colombia that requested us to team-up with them, to provide services to the InterAmerican Development Bank (IDB). The IDB needed to collect the best practice experiences regarding negotiations of Governments of Latin America Countries with concessionaires of big-scale infrastructure (Peru was included among the countries to be studied by the IDB). Duran Osorio requested us to share our knowledge on how the Peruvian Government negotiate with the infrastructure concessionaires, and specially to elaborate a detailed explanation about the main topics of discussion after the signature of the Concession Agreement. Evidently, the environmental topics are of the highest importance for any public service infrastructure project.
Our participation: We provided Duran Osorio details on the negotiations of the Government of Peru with the concessionaire of the Metro Line 2 (a USD 6.5 Billion project), including specifics of key environmental matters. Of course, in order to reinforce how certain topics are treated by the Peruvian Government we used other infrastructure deals negotiations in a comparative fashion so we could identify similarities among them.
Client benefit: The IDB as the final client of Duran Osorio was able to identify certain current negotiation practices. Based on a comparative model the IDB was able to identify if there is room to improvements and how they could be implemented in future Infrastructure Concession Contracts. This information would be useful for IDB since it regularly provides financing for this kind of projects in many countries of the Latin America region.
