San Fernando is the largest producer of poultry, eggs, pork and sausages in Perú.
In September 2022, a third party illegally entered part of the company´s property. Because of this, the company removed them, who then filed a criminal complaint against the company for the commission of the crime of usurpation and requested the authority’s support for the removal of San Fernando´s security in the area. Because of time passed, the authority did not proceed with the removal, which caused the third party to contact the representative of a close Rural Community for him to file a new criminal complaint and present a new request for removal.
It is necessary to mention that regarding the second removal request, we obtained the information presented by the complainant and elaborated our defense strategy to prevent its acceptance. Between our defense strategy, we presented the documentation proving the company´s property and possession and the complainant´s intention to obtain illicit police cooperation for the removal. As a result of our actions, the Police Department in charge of analyzing the removal denied the complainant´s request, and the company´s security remained in the property.
The first criminal complaint is under investigation. However, in relation to the second case, we presented the defence allegations and the documentation that proved the ownership and possession of the company. With this information, the Prosecutor issued a decision to close the case. It is pending the confirmation of the decision or the possible appeal by the complainant.
