COLEGIOS PERUANOS is an educational consortium with several campuses. It is in its educational activities that the mother of one of the students accused the school staff for allegedly having omitted to file a complaint with the authorities. Therefore, the Public Prosecutor’s Office initiated a preliminary investigation for the crimes of omission of denunciation, omission, refusal or delay of functional acts and criminal gang).
Our strategy consisted of presenting arguments demonstrating that the school acted in accordance with the rules established by the state Education Office for these cases, discrediting all the versions given by the student’s mother since they had no factual support.
After evaluating our arguments and noting the lack of evidence, the Public Prosecutor’s Office ordered the closure of the investigation; however, the mother of the minor appealed this decision. The Superior Prosecutor’s Office declared the appeal partially founded due to formality issues, so the Provincial Prosecutor’s Office was ordered to expand the investigation.
During this extension, the statements of the Legal Medicine Institute officials alone demonstrated that, as we had been arguing, there was no evidence of any crime, which is why the Public Prosecutor’s Office again ordered the investigation to be closed; a decision that was again appealed by the mother of the minor. In this scenario, we met with the prosecutor in charge and presented a brief refuting the arguments stated by the mother of the minor in her appeal, which were evaluated by the prosecutor in charge and that is why the appeal was dismissed; decision that was subsequently consented.
This case was very significant for the College because it protected the good image and national reputation of the educational institution, as well as that of its employees.
