This case was initiated by a criminal complaint filed by the General Prosecutor’s Office of the Regional Government of Huancavelica, who attributed to officials of the Departmental Hospital of Huancavelica and the General Manager of Draeger Peru S.A.C., the commission of the crime of aggravated disloyal collusion, under the argument that they would have concerted so that the company would sell them two mechanical volumetric ventilators for the sum of S/. 400,000.00, when there were other companies offering the same products for a lower price. Therefore, we took part in the investigation, and we offered innumerable evidentiary elements that accredited the inexistence of signs of the commission of the crime of aggravated disloyal collusion; as well as several requests of precision of the imputation framework and, in addition, focusing the defense on the fact that in Criminal Law, objective responsibility is forbidden. After the execution of several investigative acts, the representative of the General Prosecutor’s Office requested the dismissal of the case (case file) to the Preparatory Investigation Judge of Huancavelica. To date, a hearing has been scheduled to control the dismissal request, where there is a high probability that the process will be concluded satisfactorily for the company’s interests.
