Legal counsel to DRAEGER PERÚ S.A.C. in the appeal filed within the framework of Public Bidding N° LP-SM-1-2023-ESSALUD/CEABE-1 for the «Acquisition for replacement of biomedical equipment: Radiant Heat Cot – Neonatal ICU – for the Assistance Centers of the National Level Networks of the Social Security of Health (ESSALUD)», with a total estimated value of US$ 1.400 million against the award of the good pro and the evaluation of the second place of the procedure.
The case was extremely complex because DRAEGER was in third place in the overall score of the bidding and its bid was above the referential value, but it considered that the winning bidder and the second-place bidder did not meet the technical requirements. DRAEGER argued that there was non-compliance on the part of the bidders in accrediting the technical specifications and the Tribunal ruled declaring the selection procedure null and void, returning the process to the qualification stage. Case finalized.
