Legal advice to TELECOM BUSINESS SOLUTIONS S.R.L. in the framework of the coercive execution proceeding followed before the Metropolitan Municipality of Lima through its coercive execution agency, the Tax Administration Service (SAT). A writ of breach of mandate was filed in relation to the illegal application of a seizure on a telecommunications station of the client who had legal protection having won an illegal bureaucratic barrier case before INDECOPI.
The advice in the case in question was complex, because the client had to be defended against a possible seizure by the authority, which could mean a serious economic damage for the client. In this sense, we were able to successfully prove before the authority that SAT was acting illegally in breach of a mandate issued by INDECOPI, thus avoiding the seizure of the client’s premises. And, we succeeded in getting SAT to return the seized money.
