Lima Airport Partners S.R.L. (LAP) as concessionaire of the Jorge Chávez International Airport by virtue of
of the Concession Agreement executed with the Ministry of Transportation and Communications in 2001 (Concession Agreement), assigned to our client a space with an approximate extension of 77,500.00 m2 inside the Jorge Chávez International Airport for the construction and operation of a state-of-the-art Aircraft Maintenance Center for LATAM that will be the hub for the maintenance of the whole group.
To formalize the assignment of the 77,500.00 m2, we advised our client in the review and negotiation of the general and specific clauses, as well as technical exhibits of a Design, Engineering, Construction and Operation Contract (Operation Contract) involving the advice of regulatory matters: concession agreements and its compliance, construction permits, utilities, aviation, among others.
Due to our deep and complex analysis of the Operation Contract and a correct interpretation of the Concession Agreement and its exhibits, we were able to find significant saving opportunities for both our client and LAP as concessionaire, related to the cost of the supervision of the construction works and the correct application of the retribution of 46.511% over the concessionaire incomes to be carried out by our client. This was a very sensitive matter, considering that we had to deal with government actors that were involved in the operation of the Jorge Chávez International Airport such as OSITRAN (entity in charge of supervising and auditing the concession of the Jorge Chávez International Airport).
