BANCO DE CRÉDITO DEL PERÚ

Banco de Crédito del Perú (BCP) is the largest bank in Peru. It is owned by the financial conglomerate Creditors (which is a Peruvian financial holding company, with presence in Colombia, Bolivia, Chile, Panama, and the United States). It has a universal banking, insurance, and pensions platform, as well as being involved in microfinance, investment banking and wealth management in Latin America. The BCP entrusted us with the sponsorship of the «most important process of the bank» (as the legal representatives of the BCP say). This is the process initiated by Cerrón Muñoz S.A.C. against BCP, Corporation Aceros Arequipa S.A.C. and La Fiduciaria S.A.C., by which the plaintiff requests Compensation for Damages of US$116,150,251.00 that he wants BCP to pay him, in addition the plaintiff requests that Corporation Aceros Arequipa vacate the premises where it operates and demolish what was built. In this process, as lawyers of BCP we have achieved that the claim for Compensation of Damages is declared Inadmissible, that is, our client, BCP will not have to pay anything to the plaintiff. Cerrón Muñoz filed an appeal for a higher judge to rule, but after analyzing the process, supporting our position, we again obtained a favorable ruling for the BCP because the Superior Judge confirmed what was decided by the Judge of First Instance, so that the BCP will not have to pay anything to the plaintiff. The process continues, but for the other claims, that is, for the Demolition of the premises of Corporation Aceros Arequipa and the Eviction of the facilities of said company; it is a fairly complex process, but we have obtained the most favorable result for our client BCP because they will not have to pay the sum demanded amounting to US $ 116,150,251.00. As BCP lawyers, we remain vigilant that everything goes in the best interests of BCP.
