Our client, Estudios Técnicos S.A, is an engineering organization and a subsidiary of the Swiss company SGS S.A. It provides services nationwide and internationally, encompassing design, project supervision (intervention), studies, advisory and consultancy, basic and detailed engineering, project management, construction, industrial appraisals, and inspection of equipment manufacturing and assembly.
A former employee of our client initiated a lawsuit attempting to convince the court of an erroneous application of rules intended for nationals to a foreign employee. In response, we mounted a formal defence as the initial course of action, and we requested that the court declare itself incompetent based on jurisdictional grounds. The court has concurred with our argument and has consequently declared its own lack of jurisdiction, transferring the legal proceedings to an alternative jurisdiction.
This strategic move will enable our client to obtain a legal ruling from specialized judges in the new jurisdiction, based on established legal principles.
