Santa Maria’s Residents Association – Water rights

Client Requirement: To understand our client requirement, it is important to clarify first that, until just few months ago, the District of Santa Maria del Mar, did not receive water supply from the Water Service Company. Even now, only a small portion of the population in Santa Maria del Mar, is supplied by the Water Service Company. The water service supply came (and currently comes) from a water well which is administrated by our client: the Santa Maria’s Residents Association which represents more than 500 residents in the District of Santa Maria del Mar. Considering that, in the near future, the Water Supply Company can expand its service within the District of Santa Maria del Mar, our client has requested our advice to determine the best way to manage its right over the water well considering not only the present situation but a foreseen future expansion of the population that eventually cannot be covered by the Water Supply Company. Our participation: The water right of our client is a very valuable asset considering the water scarcity status. Moreover, when that source of water is destined to be used by the population for their own consumption. We designed a well-grounded legal structure that will allow our client to continue holding such a valuable resource in favour of an important number of inhabitants. Client benefit: The Association has now a clear legal solution to continue holding and using its water right for auto consumption population purposes.
