Jose Antonio Olaechea/Estudio Olaechea filed an opposition to the registration of the CANDELA JARA trademark and characteristic logo, in class 45.
The Trademark Office declared the opposition founded in the first instance; however, it was denied in the second instance. Bearing in mind that the logo requested by CANDELA JARA is almost identical to that of Estudio Olaechea and that it is vitally important to protect its brand against third parties, we initiated a legal proceeding to challenge the administrative decision.
The Contentious-Administrative Court ruled in favour of the claim. Subsequently, Candela Jara filed an appeal, which was met with an unfavorable decision from the Superior Court. In response, we have lodged a Cassation appeal. The procedural phase is currently pending analysis.
