We advised Saam Towage regarding the preparation and elaboration of a group of documents related to the legal framework on free competition, unfair competition and merger control to obtain a compendium related to our client’s Free Competition Compliance Programme, in the Peruvian case. Thus, we prepared a comprehensive Handbook on Free Competition fully adapted to the Peruvian legal framework on this matter, which also included the rules regarding unfair competition and the most important merger rules to avoid «gun jumping» scenarios. The purpose of this was to provide our client’s compliance area with this Handbook through which it can consult the assumptions regulated by Peruvian law and prevent any act by any of its employees that is contrary to free competition that may occur within the company and that may lead it to commit any infringement. In addition of the Handbook, we also reviewed, prepared and edited ten (10) other documents related to SAAM Towage’s Antitrust Compliance Programme, to adapt them to the Peruvian competition law framework; the result of the Handbook and the additional documents prepared for this purpose was highly satisfactory.
