We advised BNP Paribas (BNPP) in a questionnaire form regarding queries of corporate insolvency, as well as insolvency and restructuring proceedings for the exit of the market, among other aspects, that include our assistance in relation with loan transactions secured by pledge, equity financing, collaterals, the existence of treatment between local and foreign creditors, and the liability regarding these matters, when it arises some type of insolvency or restructuring. Thus, we developed the types of insolvency and restructuring schemes that exist in the Peruvian legislation and which are their features in each of these cases.
Finally, the task also involved a comparison on the possibility of executing collaterals in three scenarios: (i) corporate insolvency, (ii) insolvency and restructuring proceedings, and (iii) non-insolvency scenario, as well as the limitation on this regard under the referred scenarios.
