Fraud and misappropriation of high-value cell phones by former employee. Olaechea is assisting Nokia in filing a criminal complaint against a former employee for the unduly appropriation of our client’s resources by fraud. Particularly, the client claims that the counterparty took over 159 high-value cell phones.
Investigation formalised: We assisted with the investigation stage and presented all the evidence proving the counterparty’s involvement in the case. The Prosecution Service formalised the investigation, and the court ordered the continuation of the case.
Plea bargain under discussion: Following that, the counterparty filed a plea bargain, recognising its acts and committing itself to pay damages to the client to reduce the sanction. We recommended the client negotiate with the counterparty, accepting the plea bargain under the condition.
Settlement recognised by court: We suggested conditioning the settlement to the dismissal of the labour lawsuit that the counterparty was pursuing against our client. The counterparty accepted the terms of the settlement, which was recognised by the court.
Suspension of sentence conditioned to payment of damages: The decision also convicted the counterparty for unlawful appropriation and fraud, imposing three years of suspended imprisonment and the payment of a high value of damages in 24 instalments. The payment was designated as a rule for the suspension of the sentence.
Complex dispute involving high amounts and parallel labour lawsuit: This was complex not only because of the amount involved but also because the employee filed a labour lawsuit against the client. We negotiated both cases and were able to refund the client’s money considered lost.
Latest development: The settlement was recognised by the court. However, the payment of four instalments by the counterparty is pending. We continue assisting the client until the complete fulfilment of the settlement.
