Alleged fraud to obtain sanitary registration. Olaechea is defending Viña Tacama on administrative proceedings filed by the Peruvian Environmental Health Authority (DIGESA) for alleged fraud. The counterparty alleges that our client submitted false documentation to obtain sanitary registration for one of its wines.
Internal investigations discover fraud made by former employee: We designed the client’s defence strategy for the administrative procedure and assisted it with internal investigations, which concluded that the client’s former quality control coordinator Rayza Quezada Hinostroza had been responsible for the incident. The results of such investigations were presented to DIGESA as part of the client’s defence.
Filing criminal complaint for forgery and use of false documents: The former employee acknowledged the fraud both in a sworn statement and through a recorded interview made with her consent. The client fired the employee and filed a criminal complaint. The Prosecution Service formalised the investigation regarding forgery and the use of false documents to the detriment of our client.
Safeguarding prestige of Peruvian vineyard: Tacama is the first vineyard in South America, created in the 1540s in the Ica Valley. This case is significant to our client to protect its prestige and good reputation in the national and international markets. Additionally, it was important to mitigate the effects of the administrative sanctioning procedure before DIGESA.
