Defence against alleged money laundering via acquisition of shares. We are defending Live Entertainment from a criminal complaint initiated by the Prosecution Service of Lima for money laundering. The counterparty alleges that the client’s general manager committed the crime of money laundering by acquiring shares of illicit origin following orders of Carlos Omar Heresi Chicoma.
Transactions involving amounts of presumed illicit origin: The shares were from the offshore Healey Management, a company created by Carlos Omar Heresi Chicoma to receive multimillion-dollar sums from US-based Helm Bank. Previously, the amount was transferred from the M.E. International Group’s account from the Interbank, another US-based bank. The authority considered the amounts of presumed illicit origin.
Demonstrating absence of evidence for crime with heavy imprisonment penalty: We carried out a series of procedures to demonstrate the absence of evidence of the commission of the money laundering offence attributed to our client. The investigation is in its early stages, but we have already started structuring the client defence as the money laundering offence under investigation is punishable with a heavy imprisonment penalty (15 years of imprisonment).
