We are advising ACS, a French – American Company. This arbitration proceeding was started by Protransporte and the Municipality of Lima (now both called ATU) against Collection Operator (ACS) and Buses Operators (Transvial Lima S.A.C, Lima Vias Express S.A, Lima Bus Internacional 1 S.A., and Perú Masivo S.A).
The matter in this arbitration is the invalidity and/or ineffectiveness of the agreement regarding the rate increase of the transport public services. We answered the claim with an objection on the jurisdiction of the Arbitral Tribunal and we alleged that the obligation of the Collection Operator and Buses Operators has disappeared because the ATU did not fulfill its obligation.
Therefore, in this Arbitration our success possibility is notably high.
