ACS SOLUTIONS PERU S.A. is a company dedicated to the operation of the electronic collection service for mass passenger transport. The ACS company was advised in updating the National Registry of Suppliers, which is required to contract with the Peruvian State. However, during the Registration process, the competent authority required the company to appoint a General Manager (without any legal basis and making excessive use of its powers granted by law). Despite the legal arguments submitted to the entity, the authority suspended the ACS Registry. In attention od this fact, we submitted an appeal that implied legal arguments based on constitutional and procurement law. As a consequence, the authority recognized that the requirement had no legal support and proceeded to lift the suspension of the company’s Registry and updated its information. The result of this legal strategu is a case of success and satisfaction for the client who was prevented from contracting with the State.
