We provided advisory services to APM Terminals Callao in evaluating strategies in response to a potential temporary closure risk of the North Multipurpose Terminal of Callao (TNM) by the Provincial Municipality of Callao.
Legal actions were assessed against the Municipality, regulatory actions were analysed considering the Port System Law and the Concession Contract, measures were explored with the National Intelligence Directorate (DINI) as TNM constitutes a National Critical Asset, and communications were undertaken with the National Port Authority, Ministry of Transport, and OSITRAN. The legal advice included an extensive analysis of the existence of regulations that could be qualified as bureaucratic barriers that prevent the proper development of the company and that are, in turn, contrary to legal norms, in order to see the potential of initiating an administrative procedure questioning such regulations.
