ARCADIS PERU S.A.C. is a company dedicated to providing consulting services and execution of engineering works in the country. ARCADIS was advised in the execution of the NEC Contract (New Engineering Contract) called Contract for the Provision of Professional Services NEC3 – Integral Design at the Construction Level for the Work «Delivery of the Riparian Defenses of the Matagente River», entered into between Arcadis Perú S.A.C. and the Icafal-Flesan Consortium, with the intervention of the peruvian entity the Autoridad para la Reconstrucción con Cambios as project manager, for a contracted amount of US$ 1,798,684.00. Advice on the execution of the NEC Contract involved the preparation of various reports for ARCADIS, in order to file certain claims to the contractor and determine the conditions agreed between the parties in cases such as the application of penalties, the requirement of backcharges, the liability attribution, execution of guarantees, communication of early warnings, collection of additional costs, the attributions of the state entity in the contract, among others. Likewise, the elaboration involved the preparation of different communications addressed to the consortium where the claims requested by Arcadis were supported.
