The client asked us to analyze the risk of using a plot of land of more than 16 hectares located in the district of Santa María del Mar —south of Lima—for the construction of more than 200 houses for those affected by the terrorism that took place in our country. This project was driven by government who was planning an urban development in district of Santa María del Mar. To this end, the district and national urban development regulations applicable to the land were analyzed, as well as the Urban Development Plan of the district of Santa María, which allowed us to establish that the zoning assigned to the land is one of zoned commercial and public recreation zone-zoned park, which do not allow the construction of family housing in this place. Likewise, coordination meetings were held with the members of the Association and with the Mayor of the district of Santa María, in order to consolidate the information and coordinate the legal alternatives available to solve the client’s problem. Thus, the legal report allowed the client to know with greater certainty the legal situation of the land and the alternatives to prevent the State from disposing of the land in violation of the district’s urban planning regulations, thus respecting the district’s orderly growth planning in accordance with its urban development plan.
