Clinica Internacional S.A. is a well-known clinic in Lima for the quality of its staff and the technology available to its patients.
The client entrusted us with a complaint for the commission of the crime of serious negligent injury that a patient filed against her medical staff. This complaint was based on the fact that she had been through various interventions in 2017 and 2018 that had caused serious consequences to her health that had led her to being declared legally incapacitated.
This case is very important because it questioned the capacity of the client’s medical staff, and because the image and reputation of the clinic were put at risk.
This was a very complex case because of the medical information involved, and because there was a risk of incorporation of the clinic in the investigation; in addition, several doctors of the clinic were being summoned and because the complainant was claiming a compensation of more than 2 million dollars.
A brief was presented arguing that the criminal action was time-barred, and, on this basis, the Prosecutor’s Office closed the case as it had prescribed. The complainant appealed the decision, but the Superior Prosecutor’s Office confirmed the dismissal based on the aforementioned argument.
This is an important case we won, as the client had indicated that, if necessary, he was willing to settle for up to one million dollars, but the case ended without the need to do so.
