Our firm is defending Colegios Peruanos against accusations of multiple crimes allegedly committed by several of its employees and educators at one of the branches of the school network, including rape and kidnapping committed against a 3-year-old girl.
Exonerating evidence presented successfully: This complaint led to about four additional cases, all dismissed by our defence. The investigation faced delays due to the minor’s mother’s refusal to allow psychological evaluations. We advocated for a medical examination, which found no injuries consistent with the alleged crimes, and presented exonerating evidence to counter all accusations.
Appeal filed for higher review after prosecutor closes case: Ultimately, the Prosecutor’s Office accepted our arguments and closed the case, citing the expert report on the minor’s sexual integrity and the absence of evidence supporting the alleged crimes. This decision has been appealed, and after the case was escalated to a higher court, we met with the senior prosecutor and submitted a document reinforcing our position.
Complex case marked by lack of conclusive evidence: This case is important because of the seriousness of the crimes charged, which not only compromised the freedom and reputation of the workers involved but also the prestige of the entire network of schools. In addition, the case was marked by the lack of conclusive evidence and obstacles in the investigation, such as the mother’s refusal to have the minor evaluated by experts.
Protection from unfair accusations and preservation of reputation: The success in proving the absence of corroborating elements for the accusations and in getting the case dismissed by the Prosecutor’s Office, based on an objective medical report, was crucial to protect the workers from unfair accusations and preserve the reputation of the institution.
