We have provided legal counsel to Evonik Industries, a specialized German chemicals company, through Perez Alati, Grondona, Benites & Arntsen, in matters pertaining to the regulation of genetic resources. Peru, being one of the world’s most biodiverse countries, has established specific regulations governing access to genetic resources in accordance with the Nagoya Protocol.
Our team of specialists has advised Evonik on a complex issue related to gaining access to Peruvian genetic resources. In this regard, we had the opportunity to engage with local authorities from the Peruvian Ministry of Environment. Our objective was to refine the interpretation and scope of the genetic resources regulations and to explore potential future amendments at the regulatory level.
This project has posed one of the most intricate challenges for our specialized life sciences team. It required us to thoroughly examine the origins of the genetic resources and meticulously analyse the regulatory changes that have transpired since Peru’s adherence to the Nagoya Protocol.
