Imerys – Piura

Client Requirement: Imerys is a title holder of mining concessions in Piura (a Region located in the Northern Zone of Peru). These mining concessions were just one of a series of other rights and considerations linked one to each other, such as the ownership of a strategic land, the lease agreement of a well-located warehouse, water rights, agreements with communities, among others. On time, Imerys got all environmental permits, but they become outdated. The particularity on this case was that the environmental permits were specially related with each and all of the quoted rights and considerations surrounding the mining concessions. The Client asked to preserve all linked rights and considerations while the environmental permit would suffer significant changes. Our participation: Regularly all documents (not only one) related to a Project should be amended when certain key factors of such project change. This case is special. We have faced certain new environmental regulations that appeared in time, and we were obliged to make some amendments in order to adapt the Project to such new regulations. The challenge here was to avoid forfeiting the progress in other aspects different to environmental matters. We have planned a legal structure to focus only on the environmental scope and will be submitting it soon with the governmental officers for approval. Client benefit: With the preservation of valuable breakthrough achievements, the Client would be benefited for saving tons of efforts and time.
