KAEFER KOSTEC S.A.C is a Peruvian company, part of the multinational KAEFER group, world leader in industrial services.
KAEFER has entrusted us to represent them in an important arbitration against Consorcio Cosapi-JJC-SC related to the breach and interpretation of various obligations corresponding to a contract for the insulation service executed at the Talara Refinery. Currently, said refinery is in the process of being remodeled at a cost that to date exceeds US$6,000,000,000.
The importance of this arbitration is that its result allows the termination of the contract, which does not occur due to the controversy in the interpretation of various contractual clauses, despite the fact that the works carried by KAEFER have already been completed.
During the month of February 2023, the Arbitration Court issued its award. Our team members, representing KAEFER interests, won all the claims of the lawsuit, consequently, Consorcio Cosapi-JJC-SC was ordered to pay the amount claimed, it was declared that the insulation contract was terminated and, additionally, Consorcio Cosapi-JJC-SC was ordered to pay all arbitration costs.
