Client Requirement: La Grama has a ginger industrial plant in the Jungle Region of Peru. In this specific region there are no other industry and our Client business is improving the economy of that geographic area which is very well regarded by the citizens surrounding the plant. Unfortunately, in that specific region there are few or no service providers for Residual Treatment. However, the governmental authorities seem to expect the same level of performance in respect of Residual Treatment and that situation has originated certain misunderstandings that derived in an Administrative Sanctioning Procedure. The client has requested our assistance in order demonstrate the sophisticated level of compliance with Residual Treatment despite the limitation in the surrounding area.
Our participation: Considering the particularities of this case (nobody should be obliged to comply with an impossible task) we raised up evidence of certain holes in the regulations and to fill-out those holes we invoked principles of law such as reasonability, proportionality, equal treatment, due process, cost-benefit analysis, among others. The Administrative Procedure is still ongoing.
