We advised Lenovo in a consultation formulated by them regarding an e-mail draft that would be sent by Lenovo to its sales channels and distributors, which are an integral part of Lenovo’s «Channel Framework Agreement». The question asked was specifically aimed at absolving the risks that could be generated by proposing a «suggested price» on products, on the understanding that such conduct could be considered by Indecopi (competition authority) as a vertical collusive practice. In this regard, we analysed the reasons for this and evaluated an alternative formula that would not entail such a risk to our client. We therefore shared our analysis with regard to identifying elements that could establish that we could find Lenovo in this situation, if the particular characteristics are identified. The way out and the reason why we believed it was better to do it that way was well seen and accepted by Lenovo who shared 100% our consultation absolution.
