We are representing MAR ANDINO PERÚ S.A.C, a Peruvian company, in an arbitration claim filed by Peruvian Aquaculture S.A.C or PACSAC, for termination of contract, among other requests.
The dispute began with the acquisition of Pacsac shares by the company Peruvian Andean Trout S.A.C., Pacsac agreed with Mar Andino to exchange its shares in Trout for the payment of the Pacsac debts. Due to the bad economic and financial situation of Pacsac, Mar Andino ended up paying the debts of Pacsac, which amount was around 3 million US dollars.
Unreasonably, Pacsac argued that Mar Andino only paid 3 PEN (peruvian currency) for the acquired shares, which currently represents less than 1 USD.
We answered the claim and counterclaim requesting USD 3’457,000.00.
Due to the complexity of the case our work required a multi-disciplinary effort with other teams of our Law Firm.
