The origin of this case is the inspection carried out by the National Water Authority in the Punrun lagoon, where Mar Andino has two aquaculture concessions, in which it was concluded that the company had been using the water without the corresponding authorization, as well as that it had not requested authorization for metallic constructions inside the lagoon. As a result, the Specialized Provincial Prosecutor’s Office for Environmental Matters of Pasco (Case No. 372-2023), initiated a preliminary investigation for the alleged commission of the crime of environmental alteration against the company Mar Adino S.A.C. and its General Manager José Ernesto Muñoz. In this respect, we took part in the investigation and executed the defense strategy designed previously and jointly with the Environmental area of the firm, in which we proved that the facts attributed are atypical and not configuring the crime of alteration to the environment. Afterwards, we participated in the proceedings of fiscal verification in which we presented the defense arguments, prior preparation with the client. After the proceedings, we met with the Prosecutor in charge of the case, who has notified us the disposition of closure of the investigation.
