Pacífico Compañía de Seguros y Reaseguros S.A. (Pacífico) is a Peruvian insurance company. It belongs both to the Credicorp conglomerate, which also owns Banco de Crédito del Perú (BCP), and to the US Corporation American International Group.
Pacifico commissioned us to co-sponsor the judicial process of Compensation for Damages filed by Empresa de Generación Eléctrica Rio Baños S.A.C. and Sindicato Energético S.A., by which these companies seek that Pacífico compensate them for the sum of US$45,000,000.00 plus interest.
The plaintiffs point out that Pacifico must pay US$45,000,000.00 for the accident suffered at one of the plaintiffs’ facilities. However, one of Pacífico’s main arguments is that the plaintiffs could have foreseen the accident, which is why they do not have to pay anything. Within the process Pacifico has presented specialized expertise of Civil and Geographical Engineers; to prove that the damage could have been foreseen.
The Oral Report in which all parties will support their positions is next October 18, 2023, after the Oral Report, the file will be ready to be sentenced.
