Pandero S.A. EAFC

Our client acquired several offices in a corporate building in San Isidro – the financial area of Lima, under the figure of a financial lease with Banco de Credito del Perú, who is currently registered as the owner of the building and have more than 80% of participation in the building. The requirement of the client was to have the administration of the building, however, our laws require that only the owners can be elected presidents of the owners’ meetings, so we were asked to analyse the case and propose solutions. Thus, a legal study was made on the internal rules of the building and the regulations on horizontal property of our country, and we determined as alternatives for Pandero to have control of the building, to be appointed general administrator of the building, a position that implies the powers to make the maintenance charges and keep the accounts of the administration. Likewise, it was proposed that a company that has less participation in the building be appointed as president of the board of owners, and that it delegates to Pandero the judicial powers to carry out the corresponding judicial collections, all of which has been successfully executed in favor of our client.
