The client is interested in understanding the steps that they would need to take to register some of their Exchange Traded Funds (ETFs) on the Lima Stock Exchange (BVL). It was informed that PIMCO has both Irish and US domiciled ETFs and that PIMCO’s approach will be a direct listing with the BVL and not through an intermediary (Agente Promotor).
We provided a completed advice regarding the procedure in order to register the ETFs in the Lima Stock Exchange, the advisory included the step by step of each of the requirements solicited by the authority, the list of documentation needed from the issuer, the fees payable to the BVL for the listing; the benefits of effecting the listing in terms of accessing Peruvian investors; an explanation of the responsibilities and liabilities that would be applicable to PIMCO if it had ETFs listed on BVL.
We also provided advice regarding the specific questions of the procedure, the different kind of procedures depending on the foreign country in which the ETF were originally registered and depending on which is the Solicitant before the authority. It also includes an assessment regarding the level of information that need to be disclose in order to comply with the requirements solicited in the procedure.
