Criminal complaint for fraudulent collection of insurance premiums. We are assisting the insurance company Rímac with a criminal complaint of fraud against a former employee. The client alleges that the counterparty has been using the client’s identity to unduly collect premiums from Rímac’s customers, making them pay directly to its private account.
Indictment unduly reverted by court: We drafted and filed the corresponding complaint, as well as actively promoted the taking of statements and other investigative actions, culminating in the indictment of the counterparty by the Prosecution Service. However, the trial court reverted the situation, and the Prosecution Service requested the dismissal of the case.
Showcasing irregularities in proceeding: Our defence pointed out the obvious errors in the decision, including the unlawful order, which annulled the resolution that granted Rímac the status of civil actor in the process.
Favourable outcome after full court review: Nonetheless, the decision was upheld. As a result, we requested a full court review of the case and were successful. The court annulled the dismissal and reestablished the client’s status in the proceeding.
Leading insurance company part of Peruvian largest group: Rímac is the leading company in the insurance market and part of BRECA, which is the largest business group in Peru, and has more than 120 years of experience in the local market.
Protecting reputation from internal fraud and combatting irregularities within process: This case is crucial to Rímac as it involves protecting its reputation against internal fraud. Additionally, the case is complex as we had to combat irregularities committed within the proceeding.
