SAN FERNANDO S.A.

For the third time, an Habeas Corpus recourse was filed against the client in relation to their land called Ramadal, where the company has poultry activities. This recourse was based on the supposed affectation of the right of free transit of the MILAGROS BELEN mining concession holders, who are trying to access their concession through the clients´ land. This constitutional complaint was admitted by the judicial authority; however, after an analysis of the facts and the documentation presented, the recourse was declared unfounded, because the plaintiff failed to prove the easement imposed in his favor, and because SAN FERNANDO was able to prove the possession of the property since before the mining concession was granted. The closure of the case was ordered. The resolution was confirmed, concluding the case.
