Land usurpation dispute over relevant poultry production assets. Olaechea assisted the renowned poultry producer San Fernando with a land usurpation dispute against Jose Luis Alvarez Silvestre and Fundo Loma Verde. The case concerns the client’s property Pampa Hermoza, which is one of its most relevant assets, where poultry production activities are carried out.
Filing criminal complaint over violent attempt of taking possession: After a group of people associated with the counterparty violently attempted to enter the client’s property to take possession of it, we filed a criminal complaint for the crime of usurpation.
Counter-complaint regarding limits of adjacent property not fenced: The counterparty had a property fenced or delimited adjacent to Pampa Hermoza and had possession documents. Thus, the counterparty also filed a complaint against our client and some of its employees for the same crime.
Meeting with PNP to avoid illegal defence of possession: Our work comprised preventing the counterparty from starting any defensive mechanism to protect the land, including police intervention. We took the necessary steps before the Peruvian National Police (PNP) in the city of Lima to prevent the illegal authorisation of the defence of possession. We also assisted the client with an investigation regarding the land possession in dispute and responded promptly to the authorities’ requests.
24-hour monitoring to avoid usurpation considering counterparty’s connections: The case was of vital importance to our client because the counterparty had connections in the area and tried to take possession of part of the land that was not in its possession. It was also necessary to hire security personnel to monitor the property all day long.
Preventing removal from property with police support: Furthermore, there were attempts to remove our client from the property using the legal mechanism of defence of possession with police support. We managed to avoid it on two occasions due to our timely action.
Latest development: With our advice, the case was successfully closed without any contingencies for our client.
