Client Requirement: The Santa Maria Landowners Association is a new client of our Firm who represent more than 500 landowners of premises located in the District of Santa Maria del Mar. Among the associates there are owners of residential premises as well as social clubs and universities. Currently, the water needs of the District of Santa Maria del Mar are supplied by a water well which legal title belongs to the Association. The coming year, the District of Santa Maria del Mar will be supplied of water by the Lima Sanitary Company (Sedapal) for the first time since the creation of the District more than 60 years ago. This is an exciting milestone for the District and the Association has hired us: (i) to negotiate all contracts with Sedapal and (ii) to arrange and structure new deals regarding the new purposes of the water well.
Our participation: The two tasks trusted by the Association to us are of the highest importance to the District, and the Association has hired us because of our reputation on sophisticated natural resource legal management. As a result of our services, several of the contracts to be executed with Sedapal have already been reached out successfully, with creative but solid legal structures. Some other contracts are still under negotiation, and we expect to have also great results for them. On the other hand, we have proposed a new management structure very well legal grounded in respect to the water well in order to avoid losing any title rights over it.
Client benefit: The Association has now a clear legal roadmap to follow and some great results have already been gathered, while the rest are going to happen within the next year.
