We advised Supermercados Peruanos S.A. and provided them with the results of the audit performed on the information made available related to the management of their purchase and acquisition processes of products to be marketed to determine the existence or not of practices that may be considered as anticompetitive within the framework of the Antitrust Law supervised by Indecopi. In this regard, the most important aspect of this advice was the handling and classification of the information to which we had access and which was contained in the data room and e-mails of the participants, which allowed us to determine the actions that brought with them red flags to be taken into account by the Client and on which measures should be taken to prevent them from transcending and being replicated in the future by its personnel and staff. In addition, we analyzed and provided scopes on the different assumptions in which the information identified could result in an anti-competitive practice and punishable by the competition authority to provide the corresponding training to its personnel who have access to privileged information from their suppliers within the framework of their purchasing processes.
